Supervisor of Elections Tim Bobanic Responds to the Resignation of Commissioner Katie Delaney
Melbourne, FL – April 9, 2026 – This week the Brevard County Supervisor of Elections Office was notified of Commissioner Katie Delaney’s resignation from County Commission District 1, effective May 2, 2026. When a vacancy occurs on a Board of County Commissioner office, Florda Statute charges the Governor with filling the vacancy by appointment once the resignation is received and accepted by the Governor.
Florida Statute states that if there are 28 months or more left in the term of the resigning commissioner, the Governor’s Office will make an appointment to serve until the first Tuesday after the first Monday following the next General Election. In this case, Commissioner Delaney’s resignation is effective on May 2, 2026 and her term ends on November 19, 2028, which is more than 28 months. As a result, Governor DeSantis is required to fill the vacancy by appointment, and an election will be conducted this year to fill the remainder of her term through 2028.
“After confirmation from the Governor and the Florida Division of Elections, for the upcoming 2026 General Election, the District 1 seat for the Brevard County Commission will be on the General Election ballot along with the District 2 and District 4 County Commission seats that have terms ending this year,” stated Supervisor of Elections Tim Bobanic. “Candidates choosing to run for this race will follow the qualifying dates for County Office, which run from noon on Monday June 8, 2026, through noon on Friday, June 12, 2026.”
